CLAIMS AND LEGAL
Independent Assessments, Training, and Technical Support for Insurance and Legal Professionals
Energetic Mitigation Solutions LLC (EMS) provides specialized training, independent assessments, and advisory services to support claims professionals, insurance carriers, and legal teams dealing with incidents involving energetic materials, blasting, and vibration-related impacts.
Our work helps clients evaluate risk, assess alleged damage, establish defensible positions, and make informed decisions grounded in technical data, field observations, and real-world operational experience.
Independent Assessments and Claims Support
EMS is retained to perform independent technical assessments related to alleged blasting and construction impacts, including assessment work performed on behalf of insurance carriers such as Lancer Insurance Company.
Our assessment services include:
- Independent site inspections and field observations
- Review of blasting records, monitoring data, and contractor documentation
- Evaluation of alleged blast- or vibration-related damage
- Differentiation between blast effects, pre-existing conditions, typical wear, and construction deficiencies
- Clear, defensible reporting suitable for claims adjustment, litigation support, and regulatory review
Our deliverables are structured to withstand audit, expert review, and legal scrutiny.
Aerial Data Capture and Site Documentation
When appropriate, EMS can incorporate unmanned aerial systems (UAS) as an available option in support of independent assessments and claims investigations. This capability is used when conditions warrant or when requested to improve access, accuracy, and the defensibility of technical findings.
Drone-based documentation allows EMS to safely capture site conditions that may be restricted, elevated, or otherwise difficult to access, while producing high-resolution imagery that supports objective analysis and expert reporting.
This option may be used to:
- Document site conditions related to alleged blasting or construction impacts
- Capture conditions of structures, rock faces, and surrounding infrastructure
- Support damage assessments and claims investigations
- Provide visual documentation suitable for technical reports, audits, and legal review
- Supplement field observations with repeatable, time-stamped records
All UAS operations are conducted in accordance with applicable FAA regulations and are performed by qualified personnel trained in aviation safety and field investigation practices.
Training Programs
EMS training programs equip claims and legal professionals with essential vocational knowledge in the field of energetic materials. This foundational understanding strengthens claim evaluation, loss prevention, underwriting decisions, and legal analysis by improving technical literacy and risk awareness.
Our curriculum is developed and delivered by subject-matter experts with backgrounds in commercial blasting, pyrotechnics, law enforcement, and fire services, offering practical insight into an often misunderstood and high-risk domain.
Energetic Materials Overview
A foundational course introducing the types, classifications, and behaviors of energetic materials. Designed to provide working knowledge of terminology, properties, and applications relevant to claims evaluation and legal review.
Safe Storage and Logistics of Energetic Materials
Covers critical safety principles and regulatory requirements governing the storage and transport of energetic materials, supporting compliance evaluation and liability analysis.
Commercial Blasting
An overview of commercial blasting operations, monitoring practices, regulatory oversight, and risk controls. Supports claims investigations and legal review related to construction and infrastructure projects.
